Domain Registration Agreement
This Domain Registration Agreement governs the registration, renewal, and management of domain names through HostPowr. HostPowr acts as a reseller — domains are registered through our accredited registrar partner. By registering or renewing a domain through us, you agree to this Agreement, our registrar partner's terms, and the applicable ICANN policies. It forms part of our Terms of Service.
1. Our Role as Reseller
- 1.1 HostPowr is a domain reseller, not the registrar. Domains are registered through our accredited registrar partner, which is the entity officially providing the registration.
- 1.2 By registering a domain through HostPowr, you also agree to the registrar's registration agreement and ICANN's policies, which apply directly to your domain.
- 1.3 We facilitate and manage your domain on your behalf but do not control registry-level decisions, disputes, or policies.
2. Domain Ownership
- 2.1 Domains registered through us are registered in your name as the legal owner (registrant), unless you specifically request otherwise.
- 2.2 As the registrant, you are the rightful owner of the domain and are responsible for the accuracy of your registration details.
- 2.3 HostPowr manages the domain on your behalf through our registrar partner's reseller interface.
3. Accurate Information & ICANN Verification
- 3.1 You must provide accurate, complete, and current registrant contact information, and keep it updated.
- 3.2 ICANN requires verification of the registrant's email address. You are responsible for completing this verification (by clicking the link sent to you) promptly.
- 3.3 Failure to verify your email or provide accurate details may result in suspension of your domain by the registrar or registry. This is outside our control and not our responsibility.
- 3.4 Providing false or invalid contact information may lead to domain suspension or cancellation.
4. Registration & Payment
- 4.1 Domains are registered only after full payment is received. We do not register domains on credit.
- 4.2 All payments are processed through Paddle.com, our merchant of record.
- 4.3 Domain pricing may change at renewal, reflecting registry and registrar pricing.
5. Renewals
- 5.1 You are responsible for renewing your domain on time to avoid losing it.
- 5.2 Where auto-renewal is enabled, you authorize renewal charges in advance of expiry. You may disable auto-renewal in your account.
- 5.3 If a domain is not renewed before expiry, it may enter a redemption or deletion period, and recovery may incur additional registry fees or may not be possible.
- 5.4 We are not liable for any loss resulting from an expired or non-renewed domain.
6. Refunds
- 6.1 Domain registrations and renewals are non-refundable once completed. This is because the registration fee is paid to the registry and cannot be reversed.
- 6.2 This applies to all domains regardless of use.
7. Transfers
- 7.1 You may transfer your domain to another registrar in line with ICANN transfer policies, subject to any applicable lock periods (typically 60 days after registration or transfer).
- 7.2 You are responsible for initiating transfers and obtaining any required authorization (EPP/auth) codes, which we will provide to the verified registrant on request.
- 7.3 Cancelling your hosting does not automatically cancel or transfer your domain. You must manage your domain separately. See our Cancellation Policy.
8. Disputes
- 8.1 Domain disputes (such as trademark or UDRP complaints) are handled at the registrar and registry level under ICANN policy, not by HostPowr.
- 8.2 We will pass on relevant notices but are not party to, and not responsible for, the outcome of domain disputes.
- 8.3 You are responsible for ensuring your domain does not infringe the rights of others.
9. Suspension & Cancellation
- 9.1 A domain may be suspended or cancelled by the registrar or registry for invalid contact details, failed verification, abuse, or violation of ICANN or registry policies.
- 9.2 We may cease managing a domain associated with an account terminated for breach of our Terms or Acceptable Use Policy.
10. Privacy & WHOIS
- 10.1 Registrant information may be processed and, subject to applicable policy and law, published in WHOIS/RDAP directories as required by ICANN and the registry.
- 10.2 Where WHOIS privacy/redaction is available and offered, it may be applied in line with the registrar's and registry's policies.
- 10.3 Our handling of your personal data is described in our Privacy Policy.
11. Limitation of Liability
- 11.1 As a reseller, our liability regarding domains is limited to the fees you paid us for the domain service, to the fullest extent permitted by law.
- 11.2 We are not liable for registry or registrar actions, domain loss due to non-renewal or failed verification, disputes, or any indirect or consequential losses.
- 11.3 This is subject to the overall limitation of liability in our Terms of Service.
12. Changes
We may update this Agreement to reflect changes in registrar, registry, or ICANN policy. The current version applies to your ongoing use of our domain services.
