Terms of Service

These Terms of Service ("Terms") govern your use of all hosting services provided by HostPowr, a brand operated under BizPowr. By ordering, accessing, or using any HostPowr service, you agree to these Terms in full. If you do not agree, do not use our services.

These Terms incorporate our Acceptable Use Policy, Backup Policy, Cancellation Policy, and Privacy Policy, which together form your complete agreement with us.

1. Definitions

"HostPowr," "we," "us," "our" — the service provider, operating under BizPowr. "You," "customer," "account holder" — the person or business using our services. "Services" — all hosting, domain, and related services we provide.

2. Eligibility & Account

• 2.1 You must be at least 18 and able to enter a binding contract.
• 2.2 You must provide accurate, complete, and current information when registering. False or incomplete information may result in suspension.
• 2.3 You are responsible for keeping your account credentials secure and for all activity under your account.
• 2.4 One person or entity is responsible per account. You are responsible for any users you authorize.

3. Services

• 3.1 We provide web hosting, domain, and related services as described on our website and in your chosen plan.
• 3.2 Services are provided on an "as is" and "as available" basis.
• 3.3 We may modify, upgrade, or change the features of our services to improve them or meet technical and legal requirements.
• 3.4 Plan specifications, including resource limits, are as described at purchase and subject to our Acceptable Use and Fair Use policies.

4. Payment & Billing

• 4.1 All payments are processed by Paddle.com, our merchant of record.
• 4.2 Fees are charged in advance for the billing period you select.
• 4.3 Services renew automatically unless cancelled before the renewal date. By purchasing, you authorize recurring charges through Paddle.
• 4.4 It is your responsibility to cancel before renewal if you do not wish to continue. Renewal charges are non-refundable except where our Cancellation Policy expressly provides otherwise.
• 4.5 Prices may change. We will give reasonable notice of price changes, which apply from your next renewal.
• 4.6 You are responsible for keeping your payment details current. Failed payments may result in suspension.

5. Suspension & Termination

5.1 We may suspend or terminate your services immediately, without refund, if you:

• Violate these Terms or our Acceptable Use Policy
• Fail to pay fees when due
• Provide false information
• Use services in a way that harms our network, other customers, or third parties
• Engage in illegal activity

• 5.2 You may cancel your services at any time through your account. Cancellation stops future renewals but does not entitle you to a refund of fees already paid, except as set out in our Cancellation Policy.
• 5.3 On termination or cancellation, your data and backups may be permanently deleted. It is your responsibility to retrieve your data beforehand.
• 5.4 We may decline to provide or renew services to anyone at our discretion.

6. Your Responsibilities

You are responsible for:

• All content and activity on your account
• Keeping your applications, scripts, themes, and plugins secure and updated
• Maintaining your own independent backups (see Backup Policy)
• Complying with our Acceptable Use Policy
• Any third-party software or licenses you use
• Ensuring your use complies with all applicable laws

7. Service Availability

• 7.1 We aim to provide reliable, high-availability services but do not guarantee uninterrupted or error-free service.
• 7.2 Services may be temporarily unavailable due to maintenance, upgrades, technical issues, or factors outside our control.
• 7.3 Any uptime commitments and remedies are governed solely by our Service Level Agreement (where applicable), and any remedy is limited to service credits, not cash refunds.
• 7.4 We are not liable for downtime, performance issues, or losses caused by third-party networks, your applications, or events beyond our reasonable control.

8. Domains

• 8.1 Domain registrations are provided through third-party registrars. By registering a domain, you also agree to the registrar's and ICANN's applicable terms and our Domain Registration Agreement.
• 8.2 Domain fees are non-refundable once registered or renewed.
• 8.3 You are responsible for renewing domains on time. We are not liable for expired domains or loss of a domain due to non-renewal.

9. Intellectual Property

• 9.1 All HostPowr branding, content, systems, and infrastructure are the property of HostPowr and BizPowr.
• 9.2 You retain ownership of your own content. You grant us the limited right to host and process it solely to provide the services.
• 9.3 You may not copy, resell, or redistribute our services except under an authorized reseller plan.

10. Data Protection

• 10.1 We process personal data in line with our Privacy Policy and applicable data protection law.
• 10.2 Where we process personal data on your behalf (as your data processor), our Data Processing Agreement applies.
• 10.3 Our infrastructure is EU-based, supporting data sovereignty and GDPR compliance.

11. Disclaimers & Warranties

• 11.1 Services are provided "as is" and "as available" without warranties of any kind, express or implied, except as required by law.
• 11.2 We do not warrant that services will be uninterrupted, secure, error-free, or meet your specific requirements.
• 11.3 You use our services at your own risk and are responsible for your own data and applications.

12. Limitation of Liability

• 12.1 To the fullest extent permitted by law, our total liability to you for any claim is limited to the amount you paid us for the service in the three (3) months preceding the claim.
• 12.2 We are not liable for any indirect, incidental, special, or consequential losses, including loss of profit, revenue, data, goodwill, or business.
• 12.3 We are not liable for data loss, downtime, security breaches of your applications, or third-party actions.
• 12.4 Nothing in these Terms excludes liability that cannot be excluded under applicable law.

13. Indemnification

You agree to indemnify and hold HostPowr and BizPowr harmless from any claims, damages, losses, or costs (including legal fees) arising from your use of the services, your content, or your breach of these Terms.

14. Changes to These Terms

We may update these Terms at any time. The current version is always posted on our website. Continued use of our services after changes constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of Belgium. Any disputes are subject to the exclusive jurisdiction of the Belgian courts, without prejudice to any mandatory consumer protections in your country of residence.
