Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of all HostPowr hosting services. It exists to protect our network, our customers, and the integrity of our infrastructure. By using any HostPowr service, you agree to this policy. Violation may result in immediate suspension or termination of your account, without refund.

This AUP forms part of, and is incorporated into, the HostPowr Terms of Service.

1. Your Responsibility

You are fully responsible for all content, activity, and traffic on your account, including the actions of your users, clients, and anyone you grant access. You must ensure that everything hosted on or transmitted through our services complies with this policy and all applicable laws.

2. Prohibited Content

You may not use HostPowr services to host, store, link to, or transmit any of the following:

• Illegal content of any kind under applicable law
• Child sexual abuse material (CSAM) — reported immediately to authorities, account terminated without notice
• Content that infringes copyright, trademarks, or intellectual property rights
• Malware, viruses, ransomware, trojans, or any malicious code
• Phishing pages, fraudulent content, or material designed to deceive
• Content promoting terrorism, violence, or illegal hatred
• Pirated software, media, or unlicensed distribution
• Content violating export, sanctions, or trade laws

3. Prohibited Activities

You may not use HostPowr services to:

• Send spam or unsolicited bulk email (UCE)
• Run open relays, mail bombing, or list-washing operations
• Conduct phishing, identity theft, or fraud
• Launch or participate in hacking, port scanning, DDoS, or any attack on other systems
• Distribute malware or compromise other networks
• Engage in cryptocurrency mining on shared hosting
• Run public proxies, VPNs, or anonymizers on shared plans
• Operate torrent trackers or facilitate illegal file sharing
• Bypass, probe, or test the security of any system without authorization
• Resell or abuse resources beyond your plan's fair limits

4. Email Use

• Bulk or marketing email must use a verified, opt-in list and an approved external sending service, not our shared mail servers.
• We enforce sending limits to protect server reputation.
• Spam complaints may result in immediate suspension.
• We may block, filter, or rate-limit mail to protect our network and IP reputation.

5. Resource Usage & Fair Use

• 5.1 Shared hosting resources (CPU, RAM, storage, inodes, processes, bandwidth) are shared among many users. Your usage must not degrade the experience of others.
• 5.2 We may throttle, suspend, or require an upgrade if your account consumes excessive resources, regardless of plan description.
• 5.3 "Unlimited" or high-allowance plans are subject to Fair Use — they are intended for normal website use, not for storage, backup dumps, file distribution, or commercial resource reselling.

6. Security & Account Integrity

• You are responsible for keeping your software, scripts, themes, and plugins updated and secure.
• Outdated or vulnerable software that compromises the server may be disabled or removed without notice.
• You must keep your login credentials secure. You are responsible for activity under your account.
• We may scan accounts for malware and security threats and take protective action.

7. Suspension & Termination

• 7.1 We may suspend or terminate your account immediately, without notice and without refund, for any violation of this AUP.
• 7.2 For severe violations (illegal content, attacks, CSAM, fraud), we will terminate immediately and may report to relevant authorities.
• 7.3 For minor or first-time issues, we may, at our discretion, notify you and allow a reasonable time to resolve before suspension.
• 7.4 Reactivation of a suspended account may be subject to investigation and a reactivation fee.

8. Reporting Abuse

To report a violation, illegal content, or abuse involving a HostPowr-hosted site, contact: abuse@hostpowr.com

Include the URL/IP, a description of the issue, and supporting evidence. We investigate all valid reports and act in line with this policy and applicable law. See also our Abuse & DMCA Policy.

9. Investigation & Cooperation

We reserve the right to investigate suspected violations, access account content where necessary to do so, and cooperate with law enforcement and legal requests. We may preserve and disclose information where required by law or to protect our network and users.

10. No Liability for Customer Content

HostPowr does not monitor all content proactively and is not responsible for content hosted by customers. Responsibility for all hosted content rests solely with the account holder. Acting on a report does not make us liable for content we did not create.

11. Changes to This Policy

We may update this AUP at any time to address new threats or legal requirements. The current version applies to your ongoing use of our services.
