Abuse & DMCA Policy
HostPowr takes abuse, illegal content, and intellectual property complaints seriously. This policy explains how to report a problem with a website or service hosted on our network, and how we respond. It forms part of our Terms of Service and works alongside our Acceptable Use Policy.
1. Reporting Abuse
If you believe a HostPowr-hosted website or service is involved in illegal activity, abuse, spam, malware, phishing, or any violation of our Acceptable Use Policy, please report it to:
Your report should include:
- The URL, domain, or IP address involved
- A clear description of the issue
- Any supporting evidence (logs, headers, screenshots)
- Your contact details
We investigate all valid reports and respond appropriately. We cannot act on incomplete or unverifiable reports.
2. How We Respond to Abuse
Depending on severity, we may:
- Investigate the reported account
- Contact the account holder to require resolution
- Suspend the affected content or account
- Terminate the account for serious or repeated violations
- Report illegal activity to relevant authorities
Severe violations — such as child sexual abuse material (CSAM), active attacks, phishing, or fraud — result in immediate suspension or termination and may be reported to law enforcement without prior notice to the account holder.
3. Copyright Infringement (DMCA-Style Notices)
HostPowr hosts on servers located in the European Union. We respect intellectual property rights and accept copyright infringement complaints in a manner consistent with DMCA principles and applicable EU notice-and-action rules, regardless of where a complaint originates.
If you believe content hosted on our network infringes your copyright, send a written notice to abuse@hostpowr.com including:
- Identification of the copyrighted work you claim is infringed
- Identification of the allegedly infringing material, with its URL or location
- Your contact details (name, address, email)
- A statement that you have a good-faith belief the use is not authorized by the rights holder, agent, or law
- A statement that the information in your notice is accurate, and that you are the rights holder or authorized to act on their behalf
- Your physical or electronic signature
Incomplete notices may not be actioned.
4. Our Response to Copyright Notices
- 4.1 On receiving a valid notice, we may notify the account holder and request removal of the material, or remove/disable access to it.
- 4.2 We may forward your notice (including your details) to the account holder.
- 4.3 Repeated infringement may result in account termination.
5. Counter-Notice
If your content was removed and you believe this was in error or that you have the right to use it, you may submit a counter-notice to abuse@hostpowr.com including:
- Identification of the removed material and its previous location
- A statement, under penalty of applicable law, that you have a good-faith belief the material was removed in error
- Your contact details
- Your consent to jurisdiction as required by applicable law
- Your physical or electronic signature
We will review valid counter-notices and may restore the material at our discretion, subject to applicable law.
6. False or Bad-Faith Reports
Submitting knowingly false, misleading, or bad-faith abuse or copyright reports is prohibited and may result in liability for the sender. We may disregard reports that appear abusive or malicious.
7. No Waiver of Rights
Acting (or not acting) on any report does not waive any of our rights, nor does it make HostPowr liable for content created or hosted by customers. Responsibility for hosted content rests with the account holder, as set out in our Acceptable Use Policy.
8. Cooperation with Authorities
We cooperate with valid legal requests and law enforcement. We may preserve and disclose account information where required by law or to protect our network, our customers, or third parties.
9. Changes
We may update this policy at any time. The current version applies to your ongoing use of our services.
